Website terms of use
Last updated October 28, 2026 · Version 1.0
The website at freesbe.net, including its help center and blog (the "Site"), is a copyrighted work of Freesbe, Inc. ("Freesbe", "us", "our" and "we"). Some features of the Site may have their own guidelines, terms or rules, which are posted with those features and form part of these Terms.
These Terms of Use (these "Terms") are the legally binding terms for using the Site. By accessing or using the Site, you accept these Terms (for yourself or the entity you represent), and confirm that you have the right, authority and capacity to do so. You may not use the Site or accept these Terms if you're under 18. If you don't agree with all of them, don't use the Site.
Using the Freesbe apps and service (chat, calls, meetings and phone) is covered by our Terms of Service. Our Privacy Policy explains how we handle personal information.
The short version
- These terms cover the freesbe.net website and help center. The Freesbe apps and service are covered by the Terms of Service.
- Use the site to learn about Freesbe and read its guides. Don't copy it wholesale, scrape it, reverse engineer it or build a competing site from it.
- We link to other sites but can't vouch for them.
- The site comes as is, and our liability for it is capped at $50.
- Disputes go to an individual arbitrator, not a court or a class action. You can opt out of arbitration within 30 days of first agreeing.
This summary, and the "In plain English" notes under the headings, are here to help you read. They aren't part of the terms, and where they and the full text differ, the full text applies.
Please read Section 8.2 carefully. It governs how disputes between you and Freesbe are resolved. It includes an agreement to arbitrate that requires, with limited exceptions, that all disputes be resolved by binding and final arbitration, and a class action and jury trial waiver.
UNLESS YOU OPT OUT OF THE AGREEMENT TO ARBITRATE WITHIN 30 DAYS: (1) YOU MAY PURSUE DISPUTES AND CLAIMS AGAINST US ONLY INDIVIDUALLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION, AND YOU WAIVE YOUR RIGHT TO TAKE PART IN A CLASS ACTION OR CLASS-WIDE ARBITRATION; AND (2) YOU WAIVE YOUR RIGHT TO PURSUE DISPUTES IN A COURT OF LAW AND TO HAVE A JURY TRIAL.
1. Accounts
In plain English: If you make an account, keep your details true and your sign-in private, and tell us if someone else gets in.
1.1 Account creation. Some features of the Site need an account ("Account"). You confirm that the registration information you give is true and accurate, and that you'll keep it so. You may delete your Account at any time by following the instructions in the help center. We may suspend or end your Account under Section 7.
1.2 Account responsibilities. You're responsible for keeping your login details confidential and for everything done under your Account. Tell us right away about any unauthorized or suspected unauthorized use of your Account or other security breach. We aren't liable for loss or damage from your failure to do so.
2. Access to the Site
In plain English: You get a limited right to use the site to learn about Freesbe and read its docs. The site and everything on it stay ours; we can change or stop it at any time, and suggestions you send us become ours to use.
2.1 License. Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to use and access the Site to learn about and evaluate Freesbe, and to read its documentation for your own use of Freesbe.
2.2 Restrictions. The rights granted to you are subject to these restrictions: (a) you won't license, sell, rent, lease, transfer, assign, distribute, host or otherwise commercially exploit the Site or any content on it; (b) you won't modify, make derivative works of, disassemble, reverse compile or reverse engineer any part of the Site; (c) you won't access the Site to build a similar or competing website, product or service; and (d) except as expressly stated here, no part of the Site may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means. Future releases, updates or additions to the Site are subject to these Terms. All copyright and other proprietary notices on the Site must be kept on all copies.
2.3 Modification. We may change, suspend or discontinue the Site, in whole or in part, at any time, with or without notice. We aren't liable to you or anyone else for doing so.
2.4 No support or maintenance. We have no obligation to provide support or maintenance for the Site. Support for the Freesbe service is described in the Terms of Service.
2.5 Ownership. We or our suppliers own all intellectual property rights in the Site and its content, including copyrights, patents, trademarks and trade secrets. Neither these Terms nor your access to the Site transfers any of them to you or anyone else, except the limited access rights in Section 2.1. We and our suppliers reserve all rights not granted here. There are no implied licenses.
2.6 Feedback. If you give us feedback or suggestions about the Site ("Feedback"), you assign to us all rights in it, and we may use and exploit it in any way we see fit. We treat Feedback as non-confidential and non-proprietary, so don't send us information or ideas you consider confidential or proprietary.
3. Indemnification
In plain English: If a third party claims against us because of how you used the site, or because you broke these terms or the law, you cover the cost.
You'll indemnify and hold us (and our officers, employees and agents) harmless, including costs and attorneys' fees, from any claim or demand by a third party arising from (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of applicable laws or regulations. We may, at your expense, assume the exclusive defense and control of any matter you must indemnify us for, and you'll cooperate with our defense. You won't settle any such matter without our prior written consent. We'll use reasonable efforts to tell you about any such claim when we learn of it.
4. Third-party links, ads and other users
In plain English: Other sites we link to aren't ours to vouch for, and what happens between you and other users is between you. You release us from claims that come from using the site.
4.1 Third-party links and ads. The Site may link to third-party websites and services or show third-party advertisements ("Third-Party Links & Ads"). We don't control them and aren't responsible for them. We provide them only as a convenience and don't review, approve, monitor, endorse, warrant or make representations about them. You use them at your own risk, and the third party's terms and policies, including its privacy practices, apply.
4.2 Other users. Your interactions with other users of the Site are solely between you and them. We aren't responsible for loss or damage resulting from them, and we don't have to get involved in disputes between you and another user.
4.3 Release. You release and forever discharge us (and our officers, employees, agents, successors and assigns) from every past, present and future dispute, claim, demand, obligation, liability and cause of action of every kind (including personal injury, death and property damage) arising directly or indirectly from, or relating to, the Site, including interactions with other users or Third-Party Links & Ads. IF YOU'RE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE SECTION 1542 FOR THIS RELEASE, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY."
5. Disclaimers
In plain English: The site comes as is, with no promise that it's always up, accurate or error-free. Where the law insists on a warranty, it lasts 90 days.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", AND WE (AND OUR SUPPLIERS) EXPRESSLY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NON-INFRINGEMENT. WE (AND OUR SUPPLIERS) DON'T WARRANT THAT THE SITE WILL MEET YOUR REQUIREMENTS, BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS, OR BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL OR SAFE. IF THE LAW REQUIRES ANY WARRANTIES FOR THE SITE, THEY ARE LIMITED TO 90 DAYS FROM YOUR FIRST USE.
Some jurisdictions don't allow the exclusion of implied warranties, or limits on how long an implied warranty lasts, so the above may not apply to you.
6. Limitation on liability
In plain English: We don't pay for indirect losses from using the site, and our total liability for it is capped at $50.
TO THE MAXIMUM EXTENT THE LAW ALLOWS, IN NO EVENT ARE WE (OR OUR SUPPLIERS) LIABLE TO YOU OR ANY THIRD PARTY FOR LOST PROFITS, LOST DATA, COSTS OF SUBSTITUTE PRODUCTS, OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF WE'VE BEEN TOLD OF THE POSSIBILITY. YOU ACCESS AND USE THE SITE AT YOUR OWN DISCRETION AND RISK, AND ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA, RESULTING FROM IT.
TO THE MAXIMUM EXTENT THE LAW ALLOWS, AND NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATING TO THESE TERMS (FOR ANY CAUSE AND REGARDLESS OF THE FORM OF ACTION) IS LIMITED TO FIFTY US DOLLARS ($50). MORE THAN ONE CLAIM DOESN'T ENLARGE THIS LIMIT. OUR SUPPLIERS HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THESE TERMS.
Some jurisdictions don't allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
7. Term and termination
In plain English: We can end your access to the site at any time, and the key sections of these terms keep applying afterwards.
Subject to this section, these Terms stay in effect while you use the Site. We may suspend or end your rights to use the Site (including your Account) at any time for any reason at our sole discretion, including for using the Site in violation of these Terms. When your rights end, your Account and your right to access and use the Site end immediately. We have no liability to you for ending your rights, including ending your Account. Sections 1.2, 2.2 to 2.6 and 3 to 8 continue after your rights end.
8. General
8.1 Changes. We revise these Terms from time to time. If we make substantial changes, we may tell you by email to the last address you gave us and/or by prominently posting a notice on the Site. You're responsible for giving us your current email address; if it isn't valid, sending the email still counts as notice. Continuing to use the Site after notice of the changes means you accept them.
8.2 Dispute resolution
In plain English: Talk to us first. Unresolved disputes go to an individual arbitrator through JAMS, not a court or jury, and not as a class action; small claims court stays open. You can opt out within 30 days of first agreeing by writing to us.
Please read this agreement to arbitrate (the "Arbitration Agreement") carefully. It requires you to arbitrate disputes with Freesbe, Inc., its parent companies, subsidiaries, affiliates, successors and assigns and their officers, directors, employees, agents and representatives (the "Company Parties"), and limits how you can seek relief from them.
(a) Applicability. Any dispute between you and any Company Party relating in any way to the Site, the services offered on it (the "Services") or these Terms ("Dispute") will be resolved by binding arbitration rather than in court, except that (1) you and the Company Parties may bring individual claims in small claims court if they qualify, stay there and proceed only individually; and (2) you or the Company Parties may seek equitable relief in court for infringement or misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights and patents). This Arbitration Agreement survives the end of these Terms and applies to all claims that arose or were asserted before you agreed to these Terms or any earlier version of them. It doesn't stop you from raising issues with federal, state or local agencies, which can, if the law allows, seek relief against the Company Parties for you.
(b) Informal dispute resolution. Before either party starts an arbitration (or a small claims case), we'll meet by phone or video, personally and in good faith, to try to resolve the Dispute informally (an "Informal Dispute Resolution Conference"). If you have a lawyer, they may join, but you'll take part too. The party starting a Dispute must give the other written notice of its intent to hold the conference ("Notice"), which will take place within 45 days of receipt unless both agree to extend it. Send Notice to us by email to legal@freesbe.net or by mail to 1646 W Snow Ave, Suite 169, Tampa, Florida 33606, USA. The Notice must include (1) your name, phone number, mailing address and your account's email address (if you have one); (2) the name, phone number, mailing address and email address of your lawyer, if any; and (3) a description of the Dispute. Each conference is individual: a separate one is held for each Dispute, even if the same lawyers represent several people, unless all parties agree. Holding the conference is a condition for starting arbitration. Statutes of limitation and filing fee deadlines are paused while the parties go through this process.
(c) Rules and forum. These Terms involve interstate commerce, and the Federal Arbitration Act, 9 U.S.C. § 1 et seq., governs the interpretation and enforcement of this Arbitration Agreement. If the Dispute isn't resolved within 60 days after the Notice is received, either party may resolve it through binding arbitration administered by JAMS. Disputes of less than $250,000 (not counting attorneys' fees and interest) follow the JAMS Streamlined Arbitration Rules and Procedures; all others follow the JAMS Comprehensive Arbitration Rules and Procedures, both available at jamsadr.com or by calling JAMS at 800-352-5267. The party starting arbitration must send the other a request ("Request") with (1) its name, phone number, mailing address, email address and account username and email (if any); (2) the legal claims and their factual basis; (3) the remedy sought and a good-faith calculation of the amount in US dollars; (4) a statement certifying that the informal dispute resolution process was completed; and (5) proof that filing fees are paid. If a lawyer represents the requesting party, the Request must include the lawyer's contact details and be signed by them, certifying under the standards of Federal Rule of Civil Procedure 11(b) that it isn't brought for an improper purpose, that its claims are warranted, and that its facts have or will likely have evidentiary support. Unless we agree otherwise, or batch arbitration applies, the arbitration takes place in the county where you live. The arbitrator may allow a limited, reasonable exchange of information. If JAMS isn't available, the parties will choose another forum. You pay JAMS fees only as the JAMS rules provide. Everything exchanged in the arbitration stays confidential, shared only with the parties' lawyers, accountants and business advisers who agree to keep it confidential.
(d) Authority of the arbitrator. The arbitrator has exclusive authority to resolve all Disputes under this Arbitration Agreement, including about its interpretation, applicability, enforceability or formation, except that a court decides: (1) Disputes about subsection (f), including whether it's enforceable or was breached; (2) except as subsection (h) provides, Disputes about paying arbitration fees; (3) Disputes about whether a condition for arbitration was met; and (4) Disputes about which version of this Arbitration Agreement applies. The arbitration won't be combined with any other matter, except as subsection (h) provides. The arbitrator may grant dispositive motions, award money damages and any non-money relief available to an individual under the law, the forum's rules and these Terms, and must issue a written award and statement of decision with the essential findings and any damages calculation. The arbitrator follows the law. The award is final and binding, and judgment on it may be entered in any court with jurisdiction.
(e) Waiver of jury trial. EXCEPT AS SUBSECTION (a) PROVIDES, YOU AND THE COMPANY PARTIES WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL BEFORE A JUDGE OR JURY, and choose instead to resolve covered Disputes by arbitration. An arbitrator can award an individual the same damages and relief as a court and must follow these Terms as a court would, but there's no judge or jury, and court review of an award is very limited.
(f) Waiver of class or other non-individualized relief. EXCEPT AS SUBSECTION (h) PROVIDES, YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY INDIVIDUALLY AND NOT ON A CLASS, REPRESENTATIVE OR COLLECTIVE BASIS, AND WAIVE ALL RIGHTS TO HAVE ANY DISPUTE BROUGHT, HEARD, ADMINISTERED, RESOLVED OR ARBITRATED ON A CLASS, COLLECTIVE, REPRESENTATIVE OR MASS ACTION BASIS. ONLY INDIVIDUAL RELIEF IS AVAILABLE, AND DISPUTES OF MORE THAN ONE CUSTOMER OR USER CAN'T BE ARBITRATED OR COMBINED WITH THOSE OF ANY OTHER CUSTOMER OR USER. The arbitrator may award declaratory or injunctive relief only to the individual party and only as far as needed for their individual claim. If a court finally decides, with no further appeal, that this subsection can't be enforced for a particular claim or request for relief (such as public injunctive relief), that claim or request, and only that one, is severed from the arbitration and may be litigated in the state or federal courts in the State of Florida. All other Disputes are arbitrated or brought in small claims court. This doesn't stop you or us from taking part in a class-wide settlement.
(g) Attorneys' fees and costs. Each party bears its own attorneys' fees and costs in arbitration, unless the arbitrator finds the Dispute or the relief sought was frivolous or brought for an improper purpose (under Federal Rule of Civil Procedure 11(b)). A party that gets a court order compelling arbitration may recover its reasonable costs and attorneys' fees in getting it, and the winner of a court case about whether a condition for arbitration was met (including the informal process) may recover its reasonable costs and attorneys' fees.
(h) Batch arbitration. If 100 or more substantially similar Requests are filed against us by or with the help of the same law firm, group of law firms or organizations within 30 days (or as soon as possible after), JAMS will (1) administer them in batches of 100 (plus a final batch of any left over); (2) appoint one arbitrator for each batch; and (3) resolve each batch as one consolidated arbitration, with one set of filing and administrative fees per side, one procedural calendar, one hearing (if any) in a place the arbitrator chooses, and one final award ("Batch Arbitration"). Requests are "substantially similar" if they arise from the same event or facts and raise the same or similar legal issues and relief. If the parties disagree about whether Batch Arbitration applies, JAMS appoints a sole standing arbitrator to decide ("Administrative Arbitrator"), who may set procedures to decide quickly, and whose fees we pay. The parties will cooperate in good faith with JAMS to put Batch Arbitration in place, including paying single fees per batch and steps to reduce time and cost, such as a discovery special master and an expedited calendar. This subsection doesn't authorize any class, collective or mass arbitration or action, or joint or consolidated claims, except as it expressly says.
(i) 30-day right to opt out. You may opt out of this Arbitration Agreement by sending written notice of your decision to Freesbe, Inc., 1646 W Snow Ave, Suite 169, Tampa, Florida 33606, USA, or by email to legal@freesbe.net, within 30 days after first becoming subject to it. Include your name and address and a clear statement that you want to opt out. If you opt out, the rest of these Terms still applies to you. Opting out doesn't affect other arbitration agreements you have or later make with us.
(j) Invalidity and expiration. Except as subsection (f) provides, if any part of this Arbitration Agreement is found invalid or unenforceable, that part is severed and the rest stays in effect. A Dispute must be started in arbitration within the statute of limitations that applies to it, or it's barred, and statutes of limitation apply in arbitration as they would in court.
(k) Modification. If we make a future material change to this Arbitration Agreement, you may reject it within 30 days after it takes effect by writing to us at the address or email above. Unless you do, continuing to use the Site or Services after the change is posted means you accept it. A change doesn't give you a new chance to opt out if you agreed to an earlier version and didn't opt out. If you reject a change, the Arbitration Agreement as of the date you first accepted these Terms (or accepted later changes) stays in effect. We'll keep honoring valid opt-outs made under earlier versions.
8.3 Export. The Site may be subject to United States export control laws and to export or import regulations in other countries. You won't export, re-export or transfer, directly or indirectly, any US technical data you get from us, or products using it, in violation of United States export laws or regulations.
8.4 Disclosures. We're located at the address in Section 8.8. If you're a California resident, you may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 400 R Street, Sacramento, CA 95814, or by phone at (800) 952-5210.
8.5 Electronic communications. Communications between you and us are electronic, whether you use the Site or email us, or we post notices on the Site or email you. For contractual purposes, you (a) consent to receive communications from us electronically; and (b) agree that all terms, agreements, notices, disclosures and other communications we provide electronically meet any legal requirement they would meet in writing on paper. This doesn't affect your non-waivable rights.
8.6 Entire terms. These Terms are the entire agreement between you and us about using the Site. Not exercising or enforcing a right or provision isn't a waiver of it. Section titles are for convenience only and have no legal effect. "Including" means "including without limitation". If any provision is held invalid or unenforceable, the others are unaffected and the invalid one is modified so it's valid and enforceable to the maximum extent the law allows. You're an independent contractor, and neither of us is the other's agent or partner. You may not assign, subcontract, delegate or transfer these Terms or your rights and obligations under them without our prior written consent; any attempt to is void. We may freely assign these Terms. They bind assignees.
8.7 Copyright and trademarks. Copyright © 2026 Freesbe, Inc.. All rights reserved. All trademarks, logos and service marks ("Marks") on the Site are ours or belong to third parties. You may not use them without our prior written consent or the consent of the third party that owns them.
